We are aware of the latest guidelines in regards to standards of care. As a part of the Personal trainers' certification, we should attain a certain level of competency and stick to the established standard of care - otherwise, negligent acts classified as either act of commission or omission.
If a client gets injured during an exercise because of lifting heavy weights or exceeding their heart rate, then, I am liable. That is an act of omission. The trainer should be able to spot when the client is lifting heavier weights, and from their assessment and introduction to the gym, the instructor should get all information about the client to avoid giving the exercises that might harm them. For safety reasons and care, trainers should understand what is considered negligence. It is also necessary to take precautions like obtaining insurance which I have incorporated in my practice.
