A business owner has been diagnosed with lung cancer, and he has tried to apply for medical insurance which has to turn out to be a problem because of the difficulties in signing on to the healthcare.gov website. Due to this problem, the business owner has opted to call the 800 number as an alternative to inquire about the health insurance coverage. Even after calling this number, he has not received help yet. He is only given the promises of what will be carried to ensure that he is covered. Currently, the businessman has been admitted to the hospital and does not have any health care insurance to cover him, and he is losing faith in the government as well as himself. As a result of this, the family of the businessman had decided to file the lawsuit against the government for not providing him with insurance cover. The best action that would have helped the business owner in this situation is follow up on the matter in court. The government had failed on its role of providing affordable health care to its citizen. By using the government, the court will find that it has violated its right to ensuring access to public health. This action will help the business because the government will be forced to pay for the damages that it has caused to the businessman and to provide a health insurance cover for him. This approach will help the business owner because he will now undergo the treatment without challenges.

There are various principle of ethics which are used to help a person do what is right. In this case, certain ethical principles are at risk. According to Bosselmann (2016), the first ethical principle that is at risk is the principle of beneficence. The principle of beneficence ensures that any obligation that is done is towards the good of other people. This principle is at risk in this case because the government is denying the business owner insurance cover. Denying the business owner health cover means that he will not be able to get proper medical attention for his conditions. This matter would result in the condition being severe and might eventually lead to the death of that person. The second principle of ethics that would be at risk, in this case, is the principle of justice (Abdullah, & Valentine 2009). The principle of justice explains that every people should be treated equally. Therefore, when the business owner is being denied to access health care coverage the principle of justice is being violated. The third principle being violated is the principle of human dignity (Machold, Ahmed, & Farquhar 2008). This principle focuses on respect for humanity and doing everything possible that would protect the love of a person. In this case, the businessman has been denied the health care coverage by the government. This element means that the business owner might have some difficulties when treating the conditions. This issue might affect him, and the condition might be worse instead of improving. The other ethical principle that is at risk, in this case, is promise-keeping as well as trustworthiness. This principle advocated for the needs to stick to the promised made to other people. In this case, the government does not adhere to its promises of ensuring that the business owner receives medical care. Therefore, the government has violated the principle of promise-keeping and trustworthiness.

As a judge, the best way would be to rule in a way that will favor both teams. In this case, I would rule that the government should ensure that the business owner can access health coverage as soon as possible. It is the right of the government to ensure that all of its citizens have access to affordable medical care. One of the ways that affordable medical care is provided is through the provision of health care coverage. In this case, the business owner had problem signing into the healthcare.gov website to get the insurance cover. When the business owner called for assistance, he was just given promises of what will do so that he is covered. It is the mandate of the government to ensure that the healthcare.gov website is working and every person can quickly sign in to get medical insurance. The government has to stick to its promises of providing health care coverage. Therefore, when the government promised the business owner to ensure that he gets the health coverage and it fails, it does not stick to its promises. The second way that I would rule in this case is to ask the government to pay the business owner the damages that it has caused to him. Since the businessman is sick and requires a medical cover which he does not get until he is admitted to the hospital, he could have suffered psychological damages. The psychological damages could result from the stress since the business owner cannot be able to get health care coverage. Therefore, he could be worried that he might not have enough resources to pay for his medical care and the condition might deteriorate eventually leading to his death. The government will be required to pay some fees as compensation for this damage.
