Introduction
International humanitarian law works in Displacement Refugee Law in a number of ways. There are those certain guidelines that are provided by the International Humanitarian Law on how the order of things should flow in the event of refugees having been displaced from their homelands. All that is done by the two laws is that they prevent the displacement of people if there are no valid reasons for the displacement to take place. Moreover, if any good reason like the security of the citizens is available, the two laws are there to allow and give room for the displacement of the people even if it is seasonally. The provisions of these laws provide that the governments of the refugees affected by the displacement that takes place should be responsible for returning the people to their lands, compensating them and ensuring everyone remains safe in case of armed conflicts in events of displacement. This research proposal aims at identifying the various ways in which International Humanitarian Law works in Displacement Refugee Law.
Problem Statement
There has been a problem when it comes to dealing with and controlling refugee displacements all across the world. This problem has necessitated serious research to be done to identify the laws that would work well to control it and how the International Humanitarian Law has worked with displacement laws and solved the problem.
Objectives
This study and research are aimed at identifying more effective ways in which international humanitarian law would be applied in the control of refugee problems without creating room for more complex problems.
Hypothesis
The main hypothesis of the study is if the International Humanitarian Law has worked to the effective and expected levels and how its contributions have impacted in terms of problems related to refugees in the entire world.
Justification
Quite a number have been asked by various people about the issue of refugees' displacement and the solutions which have been offered to all these problems. Some typical examples which have been and are asked in regard to this issue are; Is the International Humanitarian Law really being applied and working owing to the fact that the problem of refugee displacement is increasing on daily basis? What is the core role of the Refugee Displacement Law and what has it achieved? Lastly, are there ways in which these laws could be improved so that the outcome that comes from their application will help counter all the problems that are facing refugees and posing threats to future generations? These questions have not been at any given time answered. Instead, it has not been clear on how these laws are going to be made effective and or improved. This research will identify the various ways in which the International Humanitarian Law and Refugees Displacement Law can be made better and as a result improve on the ways of dealing with refugee-related problems.
Theoretical Framework
The thesis of this research will be based on the disciplines of the general law and international relations drawing the points from the theoretical frameworks of the theories, the concepts and lastly all those approaches that have earlier been applied in the handling of this issue. These concepts and theories of the law dealing with the issue of refugee displacement will provide all necessary information regarding the subject matter. The research will focus greatly on identifying how the IHL and Displacement Refugee Laws are working the refugee problems out.
Research Methodology
The main methods of research that will be used in the data collection regarding the International Humanitarian Law and Displacement Refugee Law are;
Interviews
In the data collection of the IHL in refugee displacement law, interviews will be used in the collection of data. The interviews will be conducted on various persons like the ones who are and have worked with the IHL and other firms that deal with the refugee-related issues. The questions that will be used in the obtaining of data on this issue will be whether the IHL has stood in the gap to fight for the right of the displaced people and whether it enforces the government to act accordingly in taking care of these refugees.
Case Studies
A number of case studies will be conducted within specified time frames to make sure that valid information about the IHL performance on refugee laws will be acquired. The case studies will be conducted within large geographical areas that are believed to have experienced great impacts of displacement due to various reasons. The questions to be answered in the case studies are the same ones that are analyzed in the interviews.
The data collected will be analyzed deeply and conclusions made from them concerning how the IHL and the laws of refugee displacement have worked and how they work to counter more effects on the affected people. The implications of the entire study and research will be to look at whether these laws are functioning or not.
The Key Sources
The research will make use of a number of articles, books and all other publications that will provide any valid data about the subject matter which are the laws that deal with the control of the refugee displacement issues.
Research Skills
The research will make use of simple research skills and simple language that will be easy to understand and give the best implications out of the research.
Time Planning
February 2020- Development of the main ideas of the research
March 2020 - conducting the interviews
April 2020 - conducting of the case studies
May 2020 - Analysis of the collected data from the surveys and case studies
