Notably, the concept is still used to present separate although same doctrines that show African Americans with opportunities that are equal and supports jobs, education and public transportation (Kluger, 2011) .The concept has also been used in various cases to present that even if one race is socially inferior to another, then there is a need for equality (Street, 2013). Thus, also though equality of all races advocated for, some things like color, political balance, and interaction between races could not be satisfied.

Currently, education is an essential aspect of the government due to how each it is compulsory for everyone to attend school. Thus, to be able to perform in most of the public institutions an individual should have the education (Ackerman, 2002). In this case, if any student is desired to succeed in life, he is required to have the opportunity to attain knowledge. As a result, different reactions got raised concerning the urge for educational opportunity (Street, 2013). The minority student's educational opportunity has not yet been a reality, and most consider it as a myth. In this case, there is a belief that black women and men are inferior intellectually. Therefore, considering the concept of separate but equal intellectual capacity is not a level separation.

Arguably, the education facilities for African American were different and not even close to those others were using for their studies as shown that most Negro schools were lodges, churches or shacks that did not have enough desks, blackboard and water supply (Ackerman, 2002). The school was used by counties to get state funds, after which nothing about the schools changed.

Notably, as part of separate but equal concept; mixed schools in terms of ethics and races were promoted (Kluger, 2011). Therefore, equality of student's education took place due to enhanced cross-racial understanding.
