What allegations of negligence and malpractice may be faced by someone working at your agency? Select an intervention in which you are involved and identify the precautions you need to take to prevent allegations of negligence and malpractice.

Our agency had to deal with a case of a mother who had seven children without custody and had emotionally neglected the younger one. During her visits, she would interact minimally with her youngest child and many times she stated how much she was unbothered by the infant. The mother seemed to reject, was indifferent to the welfare of the last born and seemed to prefer her other children better. This is a form of emotional neglect since all children need withholding affection from their mother. All children have a right to have a response to their failure, protection, nurturance, and their need for stimulation (Harding, 2014).

The agency took the initiative to investigate the case, offered self-counseling, removed the children from home and repaired their psychological injuries. The interventions are designed to prevent any more harm happening to the children.

How do the concepts of social work effectiveness and negligence relate to the concepts of human rights and social justice?

In our modern society, we do not successfully address some issues that need immediate solutions. Child abuse is one of the major issues that face our nation yet most cases of child abuse go neglected. Social work operates between the interface of individuals and their profession (Congress, 2017). A professional in the field should maintain a view which does not limit them to the individual being investigated for negligence. Social work as a profession primarily is concerned with the pursuit of human rights and social justice to secure the wellbeing of all beings. Environmental issues are problems of human rights and social justice.

In what ways might the experiences of diverse clients lead them to view the legal aspects of intervention differently than someone who does not face the same diversity issues?

Sensible deductive reasoning is that human rights and social justice beg social workers to look into the experiences of their clients. By having such consideration in place, a basis for intervention and conceptualization can be made about the external environment of the client and the impact it has on the well-being of those under consideration.

What are the possible legal consequences for a social worker who takes action that conflicts with or violates the agency's written policy and the NASW Code of Ethics?

It is possible for social workers to find themselves in ethical trouble because of several reasons. It is possible even for the most skilled social workers to make mistakes unintentionally. A social worker may be in trouble for failing to get a consultation, poor use of their social skills of work, failing to transfer or refer, breaches of confidentiality, conflict of interest, premature or prolonged termination, a poor keeping of records, fraudulent actions and being incompetent or having insufficient training.

In case a social worker breaks any of the agency's policies or the NASW ethics code then the board can decide to revoke his license prohibiting him from practicing social work. Legislative acts determine the legislative actions which can be taken by the board (Congress, 2017). For instance, a worker could be charged for breaking criminal law when he defrauds a client and could be imposed or charged criminally.
