Introduction
Menhaz Zaman, a Canadian immigrant was thought of by his parents and friends as obedient, respectful and a decent student who loved playing a 3D multiplayer game (Laidlaw, 2020). During last year’s summer when Menhaz was to graduate from an engineering school, he attacked and murdered his father, mother, grandmother, and sister with a crowbar. According to the police report, Menhaz attacked his mother and grandmother while they were asleep in the master bedroom of the family’s house in Castlemore, waited for his sister, Malesa, and father and killed them with the same weapon. Throughout the incident, Menhaz progressively reported his actions to his online friends on his computer. He was arrested and charged with a subset of mass murder, annihilation, that carries a maximum penalty of life imprisonment as prescribed by the criminal code. The defendant may use mental instability in defense of the felony. Menhaz was stressed and mentally unstable for being ‘a pathetic coward and subhuman’ unworthy of his parents (Laidlaw, 2020).
Toronto Officer Guilty of Assault after Blinding a Black Man (BBC News, 27 June 2020)
A Toronto police officer, Michael Theriault was arrested and charged with assault after he and his brother, Christian chased and beat Dafonte Miller, 19 injuring his left eye beyond treatment. The police report states that Theriault, who was off-duty spotted Miller and his friends attempting to rob from his truck when they chased the with Christian. The officer claimed that they wanted to arrest him, however, there was no time during the incident when he identified himself as an officer, and they beat Miller and injured his eye with a 1.3m metal pipe. Theriault and Christian’s charges of obstruction of justice and aggravated assault were dropped, but Theriault was charged with assault (BBC, 2020). The penalty for assault in Canada ranges from a peace bond to up to 10 years prison sentence depending on the circumstances. Theriault can use the need for self-policing and street justice in his defense.
Canadian Teen Charged with Terrorism over Attack Allegedly Motivated by ‘Incel Movement’ (TIME, 20 May 2020)
The teenager whose identity has been hidden because he is a minor was charged with an act of terrorism after he stabbed two women in a massage parlor in Toronto (Godin, 2020). He was charged with terrorism after the police found evidence that the action was motivated by misogyny in relation to the ‘Incel movement’ that promotes celibacy on the grounds that women are responsible for their lack of sexual relations (Godin, 2020). The Toronto police report states that the teen used a machete to stab Ashley Arzaga, 24, on 24 February and stabbed the owner of the parlor when she came to the scene to answer Arzaga’s screams. The police added that this was not the first act of terrorism connected to the ‘Incel movement.’ According to the criminal code, acts of terrorism bears a maximum penalty of life imprisonment. However, the teen’s defense could use the unconsented brainwashing of a minor by an organized adult group in his defense.
Man Charged with Theft by Power of Attorney after $40,000 Taken from his Brother (iHeartRadio, 2 July 2020)
A 63-year-old was arrested by the Owen Sound Police Service in Hepworth, Ontario, and charged with theft after he allegedly stole $40,000 from his brother (Heisel, 2020). The accused who was also his brother’s attorney stole the money donated for social assistance to clear his bill at an Owen Sound care facility. The total sum was stolen in different incidences from mid-2016. The accused was charged with breach of trust, theft by power of attorney, and theft over $5,000. The criminal code of Canada provides that theft of property valued above $5,000 is indictable and has a maximum penalty of 10 years in prison. His defense can possibly use food emergencies to justify theft.
