On this night of December 15, 2017, I was walking home at approximately 10:00 pm. I was coming from Tailgate Charlie's where we were celebrating because we had won the last volleyball game of the season.
I was walking along the south side of the road carrying my gym bag. At around 40 meters away from the intersection, I saw a girl almost crossing the Min Streets from James Street. Seconds later, I saw approaching heading in the same direction. I think that she was not aware that the car was going to cross the same street. The building along this street blocked me from seeing the lights. However, I remember that after the collision, I looked at the crosswalk signal and saw a flashing red hand and therefore the color of light on James was green.
After the incident, I found the girl lying on the road and helped her get off the road. She called her father and explained that the man had run a red light from nowhere. I also talked with the driver who later introduced himself as Vance after he came out of his car holding a phone. Vance was a tall white guy and I noted he was also rude. I left the scene when the girl's father arrived. Her name was Victoria or Vanessa but I noted she had a kind heart.

Immediately when the police arrived at the scene, they found important evidence that will be proved in this case. Physical evidence is one of them and will be very helpful in proving the extent of an injury Vanessa suffered. There was blood in her clothing and this shows her physical injuries very dramatically. The private investigator photographed the injuries immediately and after the few days after the accident to preserve them because they heal fast. The investigator also took some pictures of the damaged car that belongs to Vance before the repair. The pictures were taken from different angles to accurately capture the condition of the accident. This will be enough proof to show that the accident happened and that the plaintiff suffered some physical injuries caused by the defendant's car.
The police were involved in this case and recorded it in their reports. In the report, the police found the defendant liable for the accident because he was on the phone while driving. He also confused by the call and ran the red light without checking the road. Vanessa was taken to a hospital after the accident and there is a medical record of the injuries she suffered after the accident. These will be enough proof of how serious the accident was.
It is against the law for anyone to text, call or receives a call while driving. According to Jones, an eyewitness Vince got out of his car holding a phone which means he was talking to someone when crossing the street and that was the reason why he ran the red light immediately. It is unlawful to use a mobile while driving to read a text, follow maps, call or receive a call or check on social media. The law applies even if the driver stops at traffic lights. In this case, the plaintiff lawyer has an advantage since there is an eyewitness who is willing to testify in her favor. Jones, who was coming from volleyball celebration on that night, saw almost everything that happened. In his statement, he stated clearly that the girl was innocent of the accident because he crossed the road when the color of street light was green. He also added that Vince got out of his car talking on a phone that means that he was on call while driving. Moreover, Jones recorded that Vince was the kind of a person who does not care what happens to others and that was the reason why he abused Vanessa of walking aimlessly on the road. He is proud and arrogant and therefore he has no respect for the poor.
