Some may opt to deliver on its arguments relating to the support and why it should be supported while others deliver claims on why it is not worth defending. However, the constitution is worth defending because of various occurrences. The U.S constitution has ensured the establishment of justice, provided the common defense, and also rendered the insurance of domestic tranquility (Amar, 2012). In the delivery, if the constitution, its deliver occurrence years after the declaration of independence. The document was signed over 11 years after the declaration of independence which elaborates on some of the reasons as to why it is worth defending. In the details of signing the document, the signers rendered clear statements pertaining the happening after various happening and strives. The constitution took the American forefathers more than eleven years to ensure the provision of the document. During intervention through the making of the constitution which took many years, the forefathers went through a series of diplomacy, debates, discussion, and strife occasion to ensure its formation. After the formation of the constitution, it maintained the formation of the structure "government" through the implementation and division of states. As per the happening and details within the document, it still offers the advantages to date whereby, it had ensured the establishment of justice since it acts as a blueprint for the requirements of the people. Also, it has proved major significance especially in ensuring the domestic tranquility that is critical in creating a common defense responsible for the protection of the U.S gaining use through the use of the military at different contexts and instances. Democracy is something that would not be built in a day or two, it takes due processes and sacrifices among other happening, thus the document is worth defending to date since it creates an imprint on what the strive for democracy entails (Dahl 2003).
Moreover, the constitution is worth defending through various occurrence since it promotes the general welfare and maintains a proper security of liberty to the people and the posterity. The document might have rendered the provision of actual events and events that are essential for liberation. However, in the attempt to maintain that it delivers its duty as it is intended, various interventions are occurring. General welfare is critical especially governance and may relate to military activities through different happenings. Even after the formation of the constitution after eleven to twelve years, everything is not right but so far so good. It is acquiring various amendments which are not meant to suppress the people but render proper amendments aimed at ensuring that the people feel secure relating to the liberty and posterity. Without the constitution today, it means there would be major issues arising due to various happening that would affect the structure of the general welfare of the civilians. Under different happenings, there are chances that people feel suppressed by the constitution in case of instances for example in courts; however, as most people imply, it cuts both ways. As a matter of fact, it renders an overall protection of the population, it is not meant to protect single individuals but focus on ensuring that every person is protected which indicate the general welfare. These happenings imply on the ideology on what it takes to have democracy together with other occurrences of liberation.
Similarly, the constitution has ensured the formation of more unions within the structure of the governments, within states and other nations. For a period not less than 200 years ago, during the signing of the constitution by the sons of liberty, there are evidences as to how the happening had ensured an appropriate structure especially in ensuring the establishment of the government and laying the grounds with foundation for the creation of U.S. the constitution is responsible for the overseeing of numerous activities in the nation. The activities are not only meant to render the development U.S but are a backbone of its existence. For example, occurrences such as the availability of elections. The election in the U.S has helped in the adherence to the national liberty among other happenings responsible for ensuring the government operates as required. The document entails a proper description and dividing of the most important aspects especially in the formation of a nation. In the context, it provides every detail that brings about the meaning of a government and a nation. Without its formation, it means there would be a lack of reference pertaining descriptions and occurrences. With the actual making of the constitution by the founding forefathers, is designing was meant to ensure that it creates a buffer between the leaders and citizenry which is critical. The happening today are rendering major effects to the document. These effects may impact the constitution in various levels rendering a breach between the leaders and the citizenry. As a result, the American constitution is worth defending at all costs regardless of any issues especially in reference to military provisions.
As a counter argument as to whether the constitution should be protected, different occurrences render the provisions. By still adopting the constitution is a way of taking ourselves back to times when our forefathers lived almost 250 years ago. Most of the land that our forefathers knew were countries along the seaboard and was largely rural places. Most of the economic activities then revolved around the slave trade and slaves working for the American forefathers. Since the 18th centuries, many economic activities have totally been abolished such as the slave trade and new technological ways have been adopted. Those who crafted the constitution in those early days, however wise they were they could not predict the current trend of culture, technology and other aspects which is a case study of why we should not let the dead forefathers' rules which suited their economic and social situation govern us where we are in a different situation hence different needs, even the constitutional needs.
It is indeed a fact that there are many economic, social and political aspects of life in America of the current 21st century. Though with the close study, the constitution provides a legal foundation that our country is built on and if we would abandon it, it meant that we would be forming a precipitate of disaster since our future generations will change it as they grow up. That is why it is important to still not adopt it since it was not only to provide a relevance to a certain time situation but to provide a guiding torch for all those in our governments. The political structure that was used in the past centuries is not viable in our 21st century. In a case where for example one lives in a district governed by Congress as provided in the constitution but the people who live in that district have no right to choose whoever will be in that congress. Our structure for the elections of the president of the US too should not be supported in this country as provided by constitution since the electoral college decision is final regardless of the popular vote hence could be biased. It is not a constitutional provisional that is obsolete and should be scrapped of since it is not worth accepting in a time where people should have a democratic right to vote in the person of their choice (Sunstein, 2009).
Many people would definitely argue that instead of disowning the constitution we should make amendments where it seems right. The constraint seems to chip in from the article 5 which provides the guidelines for the amendment which are not practically possible to change easily. For example, even if a majority are for an amendment, a minority that isn't willing to cooperate will definitely prevent it from taking action. By disowning it and rewriting it into a new one would definitely also entrench our future generations. The constitution will improve the debate about contemporary and some of the rhetoric questions we have in our minds if it will be abandoned. Many liberals and people may argue that there are rules in place no matter if a subject is to be reasonably debated. By agreeing to not keep aside the rules in place and debating on some of the issues will improve our judgements. Without such alternatives to provide apart from the provided constitution, we will all be in an unnecessary division about who does and doesn't support it hence deviating from the real issue of reasonable policy decisions. In the history of America, even the greatest of leaders had skepticism regarding the constitution. Some even took consequential actions which were later seen off as the best decisions such as a case of the Louisiana Purchase by President Thomas Jefferson. It is not the first time in history that the constitution has been violated. Some even argue that itself was clearly an illegal document since even those who insisted on following it the most were ready to disobey it to suit a certain circumstance. At this particular time In the United States, there's an unstable situation where some people express deep commitment and loyalty to obeying the constitution while others for their own political purposes. We are in a situation where Democrats and Republicans interpret the constitution in a way that favors them and later on accuse each other of violation. The constitution has brought more division than unity and hence should be abandoned (Goldford, 2005).
However, in the argumentation of the counter argument analyzing the faults in the counterargument, various happening deliver on its invalidity. For instance, to begin with, the amendment process of the American constitution changes can come to the Constitution, but protections have been set in place to protect it from political and massive public critics. Evidence comes in the form of the limited number of amendments since 1787. To challenge the fact that limited amendments make the constitution ineffective, there are clear ways of drafting amendments outlined. There are three groups of amendments; (Clarifying-aimed at restoring legal understanding in the legal practice, remedial-aimed at correcting any existing errors and serious omissions on the constitution, the substantive-this amendme...
