For my research, I will discuss the right to counsel for illegal immigrants in the USA. For the topic, my thesis statement will be, "Since illegal migrants are the most vulnerable populations of the USA, they should be granted the right to cancel when faced with deportation charges." In my paper, I will demonstrate that the right to counsel is a human right, and immigrants should be allowed to have representation in court.
Many things have compelled me to write about the right to counsel for immigrants in the USA. There have been government and social media reactions concerning the USA's illegal immigrants in the recent past. Most people, especially those in the USA legally or native inhabitants of the land, always look at immigrants as lesser beings who deserve unheard deportation. Some research has indicated that the USA's legal inhabitants think of immigrants as people who have come to grab their jobs and opportunities (Urbina & Catherine, 2013). I believe immigrants are humans, and they should get equal rights.
During Donald Trump's campaign, he was vocal about eliminating illegal immigrants from the USA. However, the way he expressed himself sounded like he had some vengeance for some specific minorities. The most affected were the Mexicans as Trump promised to build a wall between Mexico and the USA when he becomes president. Donald Trump made it a priority to round up illegal immigrants in the USA and deport them, which I feel is inhumane. Immigrants in the USA have not had a chance to get councils to represent them whenever confronted with judicial issues. Mostly it is due to economic reasons (Urbina & Catherine, 2013). I, therefore, seek to demonstrate why these people need representation because they are no less human.
I will do this by finding literature reviews of what other scholars have written about to come up with a comprehensive report on why immigrants should be allowed to have Council representation. I will research using both case laws and legal articles on my topic.
Articles to Use
For my research, I will use scholarly and popular articles to discuss why immigrants need the right to cancel. I will use the popular article published by the New York Times, whose title is "Immigrant Detainees and the Right to Counsel" (Urbina & Catherine, 2013). The article discusses the plight of immigrants in the USA and how most of them found themselves facing charges for being in the country illegally, among other crimes. The article uses a layperson's person's language, making it easier for the audience to understand the content even if they are not in the Law Practice. Even if the article is popular, it is credible because the authors have used various specialist who talks about immigration. The immigration specialists discuss that these illegal immigrants deserve representation by the council (Urbina & Catherine, 2013). They deserve to be protected more by the states because they are the USA's most vulnerable population. This article has been published in a familiar newspaper, the New York Times.
I will use a scholarly article by Eagly, & Shafer, S. (2015), which talks about why they might want to cancel. The writers discuss that the migrants need to be represented in courts while giving statistics on how prevalent cases concerning illegal immigrants in the USA are. The article is very credible, given that it provides statistics on the state of affairs when it comes to illegal immigrants and low. The writers are practitioners of the law and, thus, authorities in the discipline. This makes the article very relevant to the topic. Even if the article has used highly technical terms and law jargon, it is still the best to use because its findings are based on empirical research. The article was published five years ago, which makes it up-to-date. This article has been published in an academic journal.
