Further, on October 2, 1993, Richard Hart, heard a sound similar to a shooting coming from his residential area at approximately 3:30 a.m. At that particular time, Hart was an acquaintance at a 7-eleven store near foothill and town center drive in La Verne. When he heard the firings between five to eight times, he took a closer view towards the target. Carney Darion (plaintiff) was the director of the student services at the American University (defendant).

Facts:

Carney was not selected for the permanent dean position when he applied for the post. Moreover, two years later, after a period of rationalizing, the American university excluded Carney from her station (Carney v. American University par.1).

The District Court excluded the letter under the federal rule of evidence (FRE) 408, that Carnie sought to introduce to prove her retaliation claim.
