Introduction
The case about and employee in ActioNet (AN) called Yang. Who was harassed by his fellow college Tymony, the two working under of L-3 National Security Solutions. Working under the same workgroup and sat four feet apart. Tymony harassing Yang led to them fired without proper evidence. After doing an investigation by the federal investigation, Yang was found innocent, and he requested his work back, but the AN did not rehire him. He filed a civil permitted complaint that the company fired him without a proper investigation, making him compensated for callous disregard.
Yang's case became a federal case because OSHA is responsible, ensuring that every worker gets his rights, and they perform their responsibilities within the organization. Yang fired without proper investigation, and the company ignored his request for rehire, yet he was innocent denied his rights, and a thorough investigation for his compensation was necessary so that he be compensated (DiSimone, 2016). ActioNet did not uphold their OSHA responsibilities by firing Yang and Tymony without a proper investigation; then, it ignored the request of Yang even though he was innocent. A willful violation is a violation in which ActioNet might be subject to penalty. AN did not have regard for Yang's health and safety, making them ignore his request leading to Yang losing his apartment, his independence, and his means of income.
Tymony's inexcusable behavior was caused by job insecurity stress making him see Yang as a competitor and not a core worker. Bullying and occupational stress are the major causes of workplace violence. These help us to understand that Tymony was a bully making him have petty excuses for making Yang feel that what he is doing is wrong, for instance, him complaining that Yang storing the cans of soda in the office freezer is wrong and eventually making him lose his temper and struggled Yang because he saw him weak(Penton,n.d).
Signs of potential violence include disregarding the health and safety of others and disrespect for authority within the organization exhibited in this case. Tymony disregarded the health and safety of Yang by struggling him when he lost his temper. Disrespect to authority exhibited when Tymony pounded his fist against a cubicle when the meeting was almost over. He had no respect for those who were present during the session and decided to interrupt it by shouting to Yang. In this case, a workplace safety trend that applies is a more holistic approach to health workplace where the organization ensures that every worker is motivated to do work not fired without a proper investigation.
