Introduction
Employment and labor laws are critical in regulating human resources in an economy. The entertainment industry is one industry that is filled with a plethora of rules that are meant to create order in the industry. DJ business exists in the entertainment industry. It is an important industry that must be regulated by the labor laws and policies that apply from the Federal regulations, State laws, and the local laws. The position in the business is a technician position that works by setting up the stage and equipment. It is a demanding job that requires adequate compensation and protection from exploitation. The business is operating in Tennessee State in the United States. Therefore, the paper attempts to describe different laws that regulate the employment of a Road Technician for the DJ business.
Laws
In the Federal Laws, there are Fair Labor Standards Act, the Employment Discrimination Act, and Employee Privacy law, among other Federal Laws and Regulations. In Tennessee State, there are laws and regulations, including Tennessee Labor Laws Breaks, Tennessee Minimum Wage, and Tennessee Severance Laws. At the county and local levels, the rules include the setting of the minimum wage, existing wage and hour laws, and the Fair Labor Standards Act. The requirements are essential in the process of ensuring that there are regulations and protection of the rights of the workers. In the context of a road technician, the laws are essential for ensuring that there are minimum wages set for the technician and also look at the hourly wages of the technician.
Federal Laws
The Federal Employment Laws are enacted to cover the United States. They are adopted in different states and form the basis of operation in the United States. One of the most important laws that can apply to the technician's case is the Fair Labor Standards Act. The Fair Labor Standards Act is a law that was enacted in the year 1938 (Guerin & Barreiro, 2016). The main intention of this act is to regulate the minimum wage of different employees. In the case of Technician, the law will ensure that the wages and salaries that are earned are set at a minimum point. The act also provides that overtime is paid for and that children are not exploited in the process.
Employment Discrimination Act is the second Federal Employment Law that applies to the Technician in the United States (Guerin & Barreiro, 2016). Employment Discrimination Act will ensure that the technician is not discriminated against based on the color, economic status, and social status. The technician is protected against any form of discrimination that the technician might face. Employee Privacy Law is meant to protect the confidential information of the technician as an employee of the business. Employee Privacy Law covers all the private and confidential information concerning the employee. Employee privacy ensures that the employers do not reveal the information of the employees unnecessarily.
State Employment Law
The business operates in the State of Tennessee and therefore, will work by the employment laws of Tennessee. The specific state laws of Tennessee that are likely to affect the position of a technician include Labor Law Breaks, Tennessee Minimum Wage, and Tennessee Severance Laws. Labor Law Breaks are essential in the process of providing breaks for the Technician in the course of the work (Mattson & Bergfeld, 2017). The Labor law gives breaks to the technician in the course of setting up the equipment in the business. The breaks are essential in ensuring that the technician is not overworked. Labor Law Break also gives the technician to have meals in the course of performing the duties. Tennessee Minimum Wage is critical in setting the minimum wage for the technician.
The setting of minimum wage works by ensuring that the technician is not exploited in the course of performing the professional functions. It is a Tennessee State law that is meant to protect the employees and other workers from exploitation from the employers by setting up a minimum wage. The minimum wage is set at an hourly rate, and this also ensures that there are maximum hours that the workers should work (Simonovits, Guess & Nagler, 2019). Beyond the maximum hours, the workers should be given an overtime payment. Tennessee Severance Law has also been enacted in Tennessee State to ensure that employers are not required to offer severance pay. However, in the case where the employers are willing to provide severance pay, then there has to be an existing contract.
Conclusion
To conclude, the entertainment business is subject to employment laws, just like other businesses. The technician will need to be protected and will need to be compensated adequately for his services. The rules exist to prevent the exploitation of the employees in the businesses and firms. There are different laws at the Federal level that are meant to protect the employees. Some of the Federal Employment laws result from the treaties and conventions that are made by the United States. At the state level, Tennessee State has different requirements that apply to employees and employers at the State. The State Laws are also crucial in the process of ensuring that the workers are not exploited. At the local level, some laws are implemented to ensure that the entertainment industry is functional and that there is no exploitation in the industry.
