Introduction
To begin with, there exist the need to define public policies and the purpose they have on the social issues. Each type of policy comes with its special purpose. For instance, the distributive policy entails the provision of benefits to the society (Friedman 2018). Mostly, the government uses distributive policy to control the affairs of the country. Unfortunately, the distributive policies no longer provide benefits to the people as they are filled with social problems which hinder their intended purpose (Tommasoli). The intended purpose of public policies is to improve the social welfare and wellbeing of the citizens. This includes the reduction in poverty levels, unemployment levels and the improvement in people's living conditions (Holman 275). Currently, our democracy has failed as it no longer represents the people; but the interest of some people in the different administrative posts. Besides, democracy has failed the people; it has failed the voting process, it has failed the prison system, has failed the Educational system. According to Friedman; the corrupt nature of democracy leads to inequality and only a small population of the Americans benefiting from the same. The American democracy needs a constitutional overhaul which will address the economy of influence.
Social Problem and Examples
When a country is exposed to poor democratic rules, there are inequalities which are presented. Democracy entails a system of the state which is concerned with the ruling of a country. Inequality has for long been associated with the increase in political and social instability (Holman 277). First, it increases the risks of investments which makes it hard for a state to grow economically. Particularly, inequality is also associated with an increase in crime rates because people are forced to engage in criminal activities rather than working or in education. When these property rights are violated, people tend to deter from physical investments on fears that their properties will be violated. From crony and capitalism, it is clear that an unequal society makes the upper class to enjoy disproportionate political powers and privileges. Broadly, the lack of a good democratically rules leads to a negative effect on the growth of a state; the net effect of inequality and poor democracy has made it hard for many states to advance. This assertion is in line with the empirical models and studies which was conducted by Holman; For instance, the study found out that there exists a negative relationship between inequality and the redistribution. Societies with an equal distribution of market incomes tend to redistribute more than others. Economists define the growth effects of specific redistributive policies and patterns (Tommasoli). From their insight, it is clear that poor democratic rule leads to a less distributive market and ultimately negative impacts on the growth of a country (Friedman 2018). At a microeconomic level, the harm that comes with inequality includes the decrease in the economic performance which is attributed to the fact that the educational performance and health standard is compromised. At a macroeconomic level, inequality can be a brake on growth and can lead to instability.
Laws, Legal Entities, and Legal Policies
Through elections, people can elect their preferred candidates to distinct elective posts. However, there are Laws, legal entities, and legal policies which define the relationship between representatives and the citizens. The rule of law is one of the most important laws that apply to everyone in a given state (Holman 278). Everyone in a democracy; the government officials, elected leaders and citizens ought to be guided by these laws which are created through an open, predetermined and transparent process. The law was first codified in western European government in Magana (Tommasoli). The core principles of this law include the four elements which define what people in a democratic society should do. First, the government and its officials and the citizens are all accountable under the same law. It is unfortunate that people have neglected this aspect which best describes a democratic state. Secondly, the laws are supposed to be stable, publicized, just and evenly applied to all people. This second clause includes the fundamental rights and core human rights which include the security of property and persons.
The third clause defines the process by which the same laws are enacted and administered. A fair democratic rule should have its laws enforced in an accessible and fairway (Hubert 144). Lastly, justice ought to be delivered in time by competent and independent representatives who are neutral. These people should be a representative of the people, and their makeup should reflect the people who they serve. The importance of this law to democracy can be seen from its implementation and challenges in different parts of the world (Friedman 2018). Recent reports about South Korea and Turkey are good entry points for understanding how the rule of law is at work.
The gap between policies and practices and the negative impacts which are associated with the poor democratic rule is associated with different dimensions, accountability and equality. Democracy and the rule of law are interlinked in a way that they are mutually reinforced in a way that they create indivisible and universal core principles and values. The state uses democracy to influence the interest and needs of the greater number which in dimension with accountability, rights and equality.
Significant Efforts
There have been huge issues that have been taken to impact the subject of popular government; especially in United Nations. There exists the abnormal state meeting on the administration of law in September 2012. The High-level Meeting of the 67th Session of the General Assembly occurred in the United Nations base camp in New York (Friedman 2018). This was on 24th September 2012. This event was mostly gone for talking about and conceding to the path forward on issues to do with vote based system. The administer of law should impact the issues of national and worldwide levels (Hubert 149). The secretary-general proposed a program of activity which was intended to grow clear control of law objectives and receive other key systems to improve discourse.
Solution Effort, Its Goals and Mechanisms
The rule of law is important in advancing the democratic rule of society, and one particular solution effort is the emphasis to be laid on the application of norms and procedures. Through these norms and procedures, there have been protections of rights and advancing the inclusiveness (Goetz 2018). A common feature that defines the democratic rule and the rule of law is the protection of rights through actual outcomes of processes and procedures. The processes and procedures should be defined by the rule by law which defines the law as an instrument used by the government. The rule of law means that the society and government are bound by the law. Primarily, the constitutional limits on the power that comes with the law is a distinctive feature that defines the democratic rule of a country.
Use of standards and systems ought to be characterized by the expansive and closures based terms instead of in thin and formal terms which is a key measurement of the manage of law-vote based system (Hubert 154). The component that accompanies this arrangement depends on the way that building majority rule government and the control of law is concurrent and commonly strengthening forms. The best outcomes will be accomplished when the lead of law is made on the premise of equity and vote based administration. The formal and substantive highlights of the run of law should be characterized in light of the procedural impact which should be defined and connected (Goetz 2018). Components to be incorporated into the procedural advancement incorporate the viable constituent framework, security of minorities and also sexual orientation balance. The control of law, secured by a free legitimate, plays a noteworthy limit by ensuring that normal and political rights and regular opportunities are protected and that the adjustment and balance of all locals are not in threat. It moreover guarantees the effective execution of the diverse associations of designated, societal and level duty from potential checks and threatening by extraordinary State performing specialists.
A majority rule state ought to be unified with a rule of organization in which all individuals, establishments and components, open and private, including the State itself, are mindful to laws that are uninhibitedly proclaimed, comparatively maintained and independently intervened, and which are solid with overall human rights norms and measures (Goetz 2018). It requires likewise measures to ensure adherence to the benchmarks of inimitable nature of the law, correspondence under the watchful eye of the law, duty to the law, fairness in the usage of the law, division of powers, enthusiasm for essential authority, legal sureness, avoidance of affirmation, and procedural and genuine straightforwardness (Hubert 158). The continuous verbal confrontations worry about a unique opportunity to weight the between linkages between well-known government, human rights and the direction of law. To ensure nearby duty inside an equitable proprietorship frameworks, it is central to consider both the dominant part manage government and control of law estimations of the exceptional period of Millennium Development Goals/Sustainable Development Goals and the potential estimation of a deliberate target on vote based framework, human rights and the keep running of law to help drive the progression inspiration.
Structural or Legal Barriers
Some of the structural barriers that come with the procedural implementation of the rule of law is that of the countries which are currently undergoing conflict which has been attributed to the democratization influence. These countries face special challenges which require the legacies of human right violation (Hubert 154). During the transitions, these countries are faced with special challenges which do not include the mention of democratization. To support the home-grown democratization process, there exist the need to include some multiple transitions which include the shift from automatic to democratic systems, command to market economies and from war to peace. On legal issues, the biggest challenge comes from the formulation of the rule of law which comes with the electoral justice as well as human rights. Citizens, including political competitors and those in opposition, have the right to be legally reimbursed and exercise their rights. A key instrument that should be included so that the program achieves the desired impact is through the electoral justice system which is supposed to link the rule of law and democracy.
The legality of defining the electoral justice system has been subjected to some actions, procedures and decisions which are not lined with the rule of law. Ultimately, this has made the electoral rights unprotected and unrestored. Thus, the electoral rights of the people have been violated and the ability to file a complaint compromised. The electoral system is a key legal element which has been manipulated to bring about false information which has subjected the democratic life into a test. Countries which have guaranteed compliance with democratic principles have created a fair and just system which comes with the principle of holding a fair and just election. Critical democratic rights believe in political equality through the accountability measures, transparency issues and political equality. In fact, the electoral system should be independent so that its decisions and ac...
