Introduction
I think that the court was right in reaffirming the decision of the District Court. In the case presented, McKee, sued the Casino to have the erroneous bonus amount paid. Despite winning the game and receiving payments, McKee was not entitled to be paid the bonus. The rules of the game were clear, and McKee was required to fully understand the rules of the game before proceeding to play. There were no rules relating to the bonus winnings. Gambling has provisions that in the event of an error, the company will not provide payments. The game did not involve any bonus, and there was no entitlement to the bonus because of an error. The winnings were to be paid since the bonus was unreasonable. Besides, McKee played once, and it could not make that she wins a bonus out of playing a single game.
Contractual Obligations and the Principle of "A Contract is a Contract is a Contract"
The term "a contract is a contract is a contract" means that any contract is binding as long as all the elements of a contract are observed. If the two parties of a contract entered into an agreement, the contract must be implemented to the later. There is no way a person can fail to perform part of their contract as long as the contract was valid. The term applies to the case based on the nature of the contract and the issues that were presented for the court's determination. In this case, there was an expressed contract between the Casino and McKee on the rules of the game. In fact, there were clear instructions on rules that governed the game. In this case, the Casino was justified to perform part of their contract by paying all the winnings. The error that occurred was not part of the contract and could be voided.
Understanding Terms and Provisions: Importance of Reading Rules in Various Contexts
There are cases where people might not read the rules or provisions of the service. One of the cases is where a person fails to read a warning sign of slippery floor or danger areas in a recreational facility. In the event that a person is injured, the victim might choose to sue the owner for the failure of providing warning of impending danger. The courts will determine who is at fault, but it is a requirement that the owners place visible signs. The other case is the one involving personal property at places such as restaurants. The restaurant can place a disclaimer that the organization will not be held liable for loss of private property. If a client loses an item such as a phone or an iPad, the restaurant will not be liable for this kind of loss.
Conclusion
I believe that the Casino applied the ethical principle of justice in this case. The actions and decisions of any party should foster justice not only to the victim but also to the offeUnderstanding Terms and Provisions: Importance of Reading Rules in Various Contextsnder. In this case, the Casino implemented justice by paying the winnings from the game. Justice was further served when the organization failed to pay an erroneous bonus winning. If the Casino had proceeded to pay the bonus even if it had no bonus rules, it would have been unjustified to the owners of the Casino. Justice is based on rules, and the rules were followed in not paying the bonus. Besides, there were clear and sufficient instructions that showed that no game was running with the potential of bonus winnings.
