Introduction

Eight Amendments is the bill which was passed to become law in the US to be able to fight criminal rights for its citizens. This bill aimed to forbid the federal government from introducing extra fines, bails and enforcement of harsh punishments to the criminals. It is the shortest bill in their constitution; it is said to have a lot of weight when it comes to its consequences. As a result of this, it has led to publicly heated debate currently.

8th Amendment Debate

Firstly, since this bill protects US citizens who are being accused with crime-related actions not to be charged with excessive bail, hefty fines and to be f from any form of corporal or inhuman punishment to the victim. The arising concerns from the public who have been claiming that even though this bill is protecting the crime victims when it comes to its enforcement the legal sector does not act in accordance. Firstly, they charge the person before they find him or her guilty. And on the other side of the law says that the person is supposed to presume innocent until presumed guilty. Therefore, they are urging the government and the related authorities to make sure that the rules are followed. Nevertheless, the purpose of this bill is to make sure that the participants or the victim are released on pending trial. And the amount of the statement required to be set up by the court of law, after a thorough search of the case and coming up with evidence if the person is supposed to be fined or released by bail. As a result, the US federal government made sure, in line with those considerations, should include critical aspects such as if the accused person has any back up from the family or any assets before bailing. However, there is the significant challenge on how to impose those bail charges because, and an individual does not have a chance of fleeing from the case. As a result, this eighth bill of rights was set as a way of making sure that all individuals are protected against any form of abuse when it comes to one's privileges.

Also, due to an increase in crime, the US government has gone ahead and requested the amendment of rules which will be governing criminals who are below 18 years and mentally challenged criminals. As a result, the court set up various laws in dealing with those parties. For instance, any person who is below 18 years and has been proven guilty of undertaking any criminal activity, then the court is supposed to enforce a fine according to the financial and economic stability of the person. Subsequently, those punishments which are said to be brutal are not supposed to be imposed on the victim at all. As a result, the government has gone ahead and started educating its citizens about their rights and privileges even to the criminals. It's because, according to their liberty and freedoms of humans, every person is entitled to enjoy his or rights and privileges no matter the circumstances one is. Moreover, their constitution has stated the power and freedoms of criminals in the eighth amendment of the country. Also, due to several deaths of inmates, the public and the Congress has stepped in and commanded the court to make sure that the inmates imprisoned have rights just like the other people. In case of any death of an inmate, then the court and the prison are liable for that action, and they can charge for that. The inmates have the right and privileges of not harassed or subjected to any lethal form of punishment which can lead to death. Other subjects which have been addressed by the eighth amendment entail the use of third forays and inadequate policies which precipitates the increased punishment for the offenders after several repetitions of criminal actions. In this law, if an offender repeats an effect for more than three times, then the weight of the charge is increased.

There are other concerns which are taken into consideration legitimate under light a punishment, which ranges from branding the victims, whipping, methods of body mutilations and even removal of the body parts. In an attempt to address all these issues, the court is supposed to set a reasonable amount of the bail to victims which would not hinder the victim's freedom. At the same time, supporting the amendment was taken into consideration because of the imposed cases such as the hefty fine for the likelihood of skipping the trials.

All this was addressed because historically extreme criminal sentences are seen as human, old and barbaric, cruel and something far away from the modern world.
