Contracts are either oral or written agreements that are enforceable by the law, and it is usually between two parties, especially when it comes to employment. The enforceability of the contract seeks to analyze the imposition of a contract before a court of law and how people perceive all types of contacts concerning the laws and regulations that seek to ensure that contracts have ethical considerations. A contract that is enforceable permits enforcements between assenting parties that aim at executing an agreement with legal considerations in place (Manimaran, 2019). Therefore, the enforceability of contracts solely depends on their ability to be imposed effectively and collectively.
The attractiveness of a particular contract to a business community depends on the underlying flexibility to be applied during a business scenario. Written are more attractive and practical in most contemporary business settings since the documentation provides security to the deals signed between the parties involved in a contractual situation. They are enforceable since they give provision of future reference in case the parties that are involved in the agreement need clarification of issues of other specifications that involve the contract that they execute.
Similarly, contracts that are written are easy to enforce in the business community since they give space that allows the existence of substantial evidence in the sense that the agreed terms can be put back to the drawing board in case of disagreements between the parties that undertake a contract (MAHMOUDI & KARBASI, 2019). In many cases, written contracts serve as essential guidelines for various actions such as payment or services that the two parties in an agreement agree to and, at the same time, refer to through a lifetime (Jäckering et al., 2020).
Consequently, in a business community, most people prefer using written contract since business require consecutive referencing to ensure that the business terms are put into consideration to achieve business goals and objectives. Written contracts are the bests for the business contract since they are considered legally binding. It is due to the sense that they ensure that the parties within a contact have documented agreement that makes sure that both parties agree about an offer that the other party makes before fully binding the contact and pronouncing it a legally renowned contract.
The advantages accrued in the written contracts provide a considerable sense of security that, in turn, makes business people prefer it more than any other form of contract like the oral one. The process has formed major transformations that have been termed as the current business trends in various business communities. Thus, explaining the reason behind the increased prefer-ability of written contracts.
In a business contract, a written contract is suitable since it ensures that the parties within the contract can seek for legal remedy since there are documentations in a legal contract that can be used as evidence and give space for the reviewing of the rules and regulations that oversee a specific agreement (Jäckering et al., 2020). Businesses require documents that clarify agreements between two parties and how the parties within a contract can put into consideration the agreements within a contract and what the parties of a contract can solve inconveniences during the contract.
Also, written agreements are enforceable in a business setting since they give space for legality in operations and ensure that the parties within a contact carry out their roles as per the documentation. The process is exceptionally applicable only when making the contract before the contract is legally bonded (Manimaran, 2019). Therefore, it is more considerable to engage in written contracts while transacting a particular business in the contemporary business setting.
Written contracts are advantageous over oral contracts since they give space for future references. Parties can refer to the written documents in case of inconveniences during a contract. The substantial evidence in a written contract ensures that there is no violation of terms that govern a contract. Written contracts provide clarity, especially when it comes to business contracts, since they ensure that parties within a contract can easily make conclusions and come to an agreement (Jäckering et al., 2020).
They also help in preventing disputes that may cause inconveniences when implementing contracts since they provide evidence that can be used as proof in case there is a little misunderstanding between parties that have a direct link to a particular contract. This is because they provide clear references in case of certain misunderstandings that may emerge after transacting a particular business.
On balance, written contracts are preferred over oral contracts since they ensure there is no misinterpretation of communication and agreements between parties that are in a contract agreement. On the other hand, an oral contract is easy to implement since it takes a short time for the parties within a contract to reach to an agreement. Oral contracts are also cheap and are not costly compared to written contracts, which require more resources to implement. However, they do not provide the required security in a transaction, which is against the contemporary business rules that guide various business operations in various settings. Thus, the setbacks make the former contract garner more advantages over the other in different ways.
