Introduction

The confusion between two rooms was the key cause of the arrest of Amber Renee Guyger for manslaughter. The police officer entered a wrong room in the night of sixth September 2018 and encountered a human shadow lacking in the darkness. In what she said was self-defense, Renee pulled out her handgun and shot two bullets thinking she had met a burglar. The owner of the apartment, Botham Shem Jean died in the hospital due to the injuries he sustained from the gunshots. Thus, the penal code title 5, chapter 19, will help us breakdown the type of crime committed by Guyger as well as the punishment she deserves.

The article dwells mostly on criminal homicide, which is in line with the penal code. Since Amber Guyger is the main perpetrator, in this case, the section provides mode details with the various offenses against her for the crimes committed. Manslaughter, capital murder, murder, and criminally negligent homicide are some of the different types of criminal homicide stated in the article. We will take a look at the various offenses to have a better understanding of the specific offenses that best describe the crime of the police officer.

An adequate cause or sudden passions are the many causes of murder. A certain degree of anger can also be a sufficient cause. A heated moment or passions caused by and arising are the leading causes of sudden passion. The offense described in the article matches none of the two descriptions above. In the case of capital murder, the victims usually die when the perpetrators are in the process of committing a different violent felony or in the process of harassing someone sexually. In the above case, it will be tough to prove that Amber Guyger murdered Botham Jean since there is no apparent reason as well as a motive to kill him. First of all, the two had never met nor knew each other before the incident that happened during that night.

In my opinion, the crime committed by Guyger during the night of September sixth, 2019 is manslaughter. When an individual commits, an action that leads to the death of another, it is considered as manslaughter. These because the murder of Jean happened in a spur of the moment since the whole action was not deliberate. Such offenses become a second-degree felony.

Also, the above case does not fall under capital murder. Amber Guyger made a mistake that night of taking Jean's life. According to me, the details of the case do not prove if the police officer committed the crime knowingly or intentionally. The punishment Guyger will face should be lenient in that because of fear and self-defense lead her on to pull the trigger. I believe the action Guyger undertook; most of us would also do the same if they found a stranger in their houses at night.

In this case, the defense attorney representing Amber Guyger will be justified to argue that their client made a mistake of fact. This statement has been previously used in the Dallas courts. The case resembles what the police officers would say that 'we thought he had a gun' after killing an individual. According to a new motion with regards with the state law, it gave the go-ahead of using a justified deadly force in self-defense.
